Charter Rule Amendments

NOTE: Several sections of 180-19 WAC are proposed to be amended by changing the dates by which various charter actions must be taken. As prepared for publication by the Code Reviser, the texts of each WAC are repeated, with headings within to indicate effective dates. The WACs as amended to change dates for charter actions after certain effective dates are shown as new, with both existing and new language underlined. In order to make it easier for readers to identify the proposed changes, the draft attached to this memo is formatted as follows:

  • Yellow highlighted text is NEW language proposed to be added
  • Underlined text is ORIGINAL language from the original version of the WAC
  • Text that is typed with ‘strike-through’ was original language that has been deleted in the amendment

At its July 9-10 meeting, the State Board of Education approved for public hearing proposed amendments to WACs 180-19-010, 180-19-020, 180-19-030, 180-19-040, 180-19-070, 180-19-080 and 180-19-090. The proposed amendments:

  • Modify the due dates for actions by school districts wishing to be charter authorizers, the State Board of Education, the Washington State Charter School Commission, and charter applicants.
  • Establish in WAC 180-19-040 a process for review and evaluation by the SBE of applications by school districts for approval as charter authorizers.
  • Clarify provisions of WAC 180-19-090 on the use of a lottery to certify approved charters as within the limits on the maximum number allowed to be established under RCW 28A.710.150.
  • Make various technical corrections and improvements.

The proposed rules will be published in the State Register, Issue 14-16, on August 8, with the OSPI fiscal impact statement required by RCW 28A.305.135.

A public hearing on the rules will be scheduled for September 10, 2014 at North Central ESD in Wenatchee, WA.
